5. Payment Terms

5.1 Pricing

All prices displayed on our Site and menus are in United States Dollars (USD) and are subject to change without prior notice. Prices do not include applicable sales taxes unless expressly stated. Tax calculations are based on applicable state and local tax rates at the time of purchase and will be itemized on your receipt or order confirmation.

5.2 Payment Methods

We are not responsible for lost, stolen, or unauthorized use of gift cards.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTHONY'S COAL FIRED PIZZA, ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use our Site or Services;
  • Any unauthorized access to or alteration of your data;
  • Any errors, inaccuracies, or omissions in our content;
  • Any conduct or content of third parties in connection with our Services;
  • Any food products purchased from us or any illness resulting from consumption thereof, except to the extent caused by our gross negligence or willful misconduct.

7.2 Cap on Liability

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF ANTHONY'S COAL FIRED PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

7.3 Basis of the Bargain

The limitations of liability set forth in this Section reflect a reasonable allocation of risk and are a fundamental element of the basis of the bargain between you and Anthony's Coal Fired Pizza. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

8. Disclaimers

8.1 "As-Is" Basis

OUR SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 9. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its parent company, subsidiaries, affiliates, and their respective officers, directors, employees, agents, licensors, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising from or relating to:

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which the relevant Anthony's Coal Fired Pizza location is situated, without regard to its conflict of law provisions.

To the extent that any dispute is not resolved through the dispute resolution process described in Section 11, you and Anthony's Coal Fired Pizza each consent to the exclusive personal jurisdiction of the state and federal courts located in the United States for the resolution of such disputes, and you waive any objection to such jurisdiction or venue.

Your use of our Services may also be subject to other local, state, national, or international laws, including but not limited to:

  • The Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive trade practices;
  • The Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.);

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our Services informally by contacting Anthony's Coal Fired Pizza at [email protected]. You agree to provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute within thirty (30) days of receipt of your notice. EXCEPT FOR CLAIMS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES. THE ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including whether a claim is subject to arbitration. The arbitrator's award shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the entire arbitration agreement shall be null and void.

11.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual claim in small claims court if the claim qualifies under the applicable rules of that court and the claim remains on an individual, non-class basis.

11.5 Jury Trial Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ANTHONY'S COAL FIRED PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES.

12. Term and Termination

12.1 Term

These Terms are effective as of the date you first access our Site or use our Services and shall remain in full force and effect for as long as you continue to use our Site or Services, unless earlier terminated in accordance with this Section.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated herein by reference, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to your use of our Site and Services, and supersede all prior and contemporaneous negotiations, discussions, agreements, representations, and understandings, whether written or oral, between you and the Company relating to the subject matter hereof.
